Terms of Service

By creating a TerraGuide account or booking a trip, you agree to these Terms of Service. If you do not agree, do not use TerraGuide. These terms apply to all users — travelers and guides alike.

TerraGuide is a marketplace that connects independent local guides ("Guides") with travelers ("Travelers"). TerraGuide is not a travel agency and does not employ guides. Each Guide is an independent contractor solely responsible for the services they provide.

You must be at least 18 years old to use TerraGuide. Guides must pass identity verification and a background check. TerraGuide reserves the right to refuse service to anyone for any reason.

Payments are processed by Stripe. Your card is charged at the time of booking. TerraGuide adds a 5% platform fee to the booking subtotal. Guides are subject to a separate 5% commission plus applicable Stripe processing fees deducted from their payout. All amounts are in US dollars. By booking, you authorize this charge.

TerraGuide is a technology platform that facilitates connections between independent guides and travelers. TerraGuide does not employ guides, does not operate tours, and is not present during any trip. By booking through TerraGuide, you acknowledge and agree that: (a) your guide is an independent contractor solely responsible for the services they provide; (b) TerraGuide is not liable for any injury, accident, property damage, loss, or dispute that occurs during or in connection with a trip; (c) you participate in all activities at your own risk; (d) in any emergency, dial 911 immediately. TerraGuide operates safety features (LiveSafe GPS, in-app chat, emergency contacts) as supporting tools only — these features do not create any duty of care or liability for TerraGuide. To the maximum extent permitted by law, TerraGuide's total liability is limited to the amount you paid for the specific booking in dispute.

You may not: impersonate any person; provide false information; use the platform for illegal purposes; harass, threaten, or harm any user; attempt to circumvent platform fees by booking off-platform; or collect personal data from other users without consent.

All content, branding, and technology on TerraGuide is owned by TerraGuide, Inc. You may not reproduce, copy, or redistribute any part of the platform without written permission.

To the maximum extent permitted by law, TerraGuide is not liable for any indirect, incidental, or consequential damages arising from your use of the platform or any trip. Our total liability is capped at the amount you paid for the disputed booking.

These Terms are governed by the laws of the State of California, USA. Any disputes will be resolved through binding arbitration in San Francisco, CA, under JAMS rules. You waive any right to a jury trial or class action.

We may update these Terms from time to time. We'll notify you by email at least 14 days before material changes take effect. Continued use of TerraGuide after that date constitutes acceptance of the new terms.
